WTSolutions - Image GPS Editor Service Agreement

1. Acceptance of Terms

By accessing or using the "Image GPS Editor" software (the "Service") provided by WTSolutions ("we", "us", or "our"), you agree to be bound by this Service Agreement (the "Agreement"). If you do not agree to these terms, you may not use the Service.

2. Service Description

Image GPS Editor is a cross-platform tool for editing GPS location information in images, supporting Windows, Mac, iOS, Linux, and Android systems. The online version does not require download or installation. It allows users to modify GPS location information in images, including latitude, longitude, altitude, and other data, and supports batch processing of multiple images. The Service also provides a map-based coordinate selection feature to help users intuitively set GPS locations.

Service Limitations and Notes:

• This Service allows modification of GPS information in photos. Users must ensure that modified GPS data complies with applicable laws, regulations, and ethical standards.
• The accuracy of GPS data depends entirely on the coordinates entered or selected by the user. WTSolutions makes no guarantees regarding the precision, accuracy, or reliability of GPS data.
• Generated file formats may have compatibility issues. Users are responsible for their own testing and verification.
• The features provided by this Service are for general use only and are not suitable for any professional measurement, navigation, or commercial purposes that require strict data precision.
• The Service may not function properly due to network, device compatibility, or other technical reasons. WTSolutions does not guarantee continuous availability of the Service.
• Regular users can process a maximum of 6 photos per session. Pro users have no limits.

3. User Responsibilities

You agree to use the Service in compliance with all applicable laws and regulations. You shall be solely responsible for:

• Ensuring you have the necessary rights to use and process the uploaded photos.
• Maintaining the security of your devices and data.
• Using the Service in a manner that does not infringe upon the rights of others or violate any laws.
• Taking full responsibility for all results arising from your use of the Service, including but not limited to any loss or damage caused by inaccurate GPS data.
• Verifying the accuracy and suitability of any files generated by the Service before use.
• Understanding and accepting that GPS data provided by this Service may contain errors and is not suitable for professional or commercial purposes requiring strict data precision.
• Using the Service for personal use only, not for commercial purposes.
• Not using the Service for any illegal activities, including but not limited to invasion of privacy or theft of trade secrets.
• Not using the Service to modify GPS data for fraudulent or misleading activities.

You expressly understand and agree that any consequences arising from your use of the Service (including but not limited to economic loss, device damage, data loss, etc.) shall be borne by you alone, and WTSolutions shall not be liable for any such consequences.

4. License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license for your personal use only. For Pro features, a Pro activation code is required. You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to obtain the source code of the Service.
• Distribute, sublicense, rent, lease, or otherwise transfer the Service to any third party.
• Use the Service for any illegal or unauthorized purpose.
• Share or transfer your Pro activation code with other users.

5. Intellectual Property

The Service, including its software, design, and content, is owned by WTSolutions and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or internal commercial purposes only. Without our prior written consent, you may not copy, modify, distribute, or reverse engineer the Service.

6. Payment Processing and Refunds

For purchases made through the Service, we use Stripe as the payment processor. By completing a purchase, you agree to the following:

• Stripe will process your payment information in accordance with its Terms of Service and Privacy Policy.
• You authorize Stripe to collect and store your email, payment method details, and transaction information to complete the transaction.
• WTSolutions does not store or access your complete payment details. All payment information is securely processed by Stripe.
• WTSolutions is not responsible for any errors, delays, or issues arising from Stripe's payment processing services.

Refund requests will be processed according to our refund policy. Please note:

• For 30-day short-term usage, refund requests must be submitted within 7 days of the purchase date.
• Refund requests must include valid proof of purchase, such as a receipt or invoice.
• Refund requests may be subject to a 10% processing fee, and processing may take 1-2 business days.
• 2-day short-term usage and perpetual licenses do not support refunds.

7. Subscriptions and Purchases

We offer two types of premium feature codes: short-term usage and perpetual license.

7.1 Short-Term Usage (Online Version Only)

Short-term usage can be used on up to 10 devices and includes access to the latest versions through updates.

7.2 Perpetual License (Desktop Installation Version Only)

Perpetual licenses can be used on a single device and provide permanent usage rights after purchase, including access to future version updates.

8. Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we handle your information. The Service runs entirely on your local device and does not collect, store, or transmit your photos, GPS data, or any other personal information to our servers or third parties. 9. Disclaimer

The Service is provided "as is" and "as available" without any express or implied warranties. WTSolutions does not warrant that the Service is error-free, uninterrupted, or compatible with your devices. You assume full responsibility for all results arising from your use of the Service.

Special Notes:

• The accuracy of modified GPS information depends entirely on user input. WTSolutions makes no guarantees regarding the accuracy, completeness, or reliability of GPS data.
• Generated files may contain errors or inaccurate information. Any consequences resulting from the use of these files are solely the user's responsibility.
• WTSolutions is not liable for any business losses, data loss, device damage, or other direct or indirect losses resulting from the use of this Service.
• Users should verify the accuracy of GPS data themselves and conduct necessary checks and confirmations before use.
• This Service is not suitable for any professional or commercial purposes that require strict data accuracy. For high-precision data needs, please use professional measurement equipment and services.

10. Limitation of Liability

To the maximum extent permitted by law, WTSolutions shall not be liable for any of the following damages:

• Direct damages: including but not limited to device damage, data loss, software failure, etc.
• Indirect damages: including but not limited to loss of profits, loss of business opportunities, loss of income, etc.
• Incidental, special, consequential, or punitive damages.
• Any loss or damage arising from the use or inability to use the Service.
• Any loss resulting from inaccurate GPS data, file format errors, or other technical issues.
• Any loss resulting from your violation of this Agreement or applicable laws and regulations.

Under no circumstances shall WTSolutions' total liability to you exceed the amount you paid for the use of the Service. If no fees were paid, WTSolutions shall not be liable for any damages.

11. Indemnification

You agree to indemnify and hold harmless WTSolutions, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising from or related to your use of the Service or violation of this Agreement.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to your violation of this Agreement. Upon termination, all rights granted to you under this Agreement will immediately cease. The Service does not store your data, so no action is required to retrieve or delete your information.

13. Changes to This Agreement

We may update this Agreement from time to time. Any changes will be posted on this page, and the effective date will be updated. Your continued use of the Service after changes constitutes acceptance of the revised Agreement.

14. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law principles. Any dispute arising from or related to this Agreement shall first be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to the competent court in the location where WTSolutions is registered.

16. Entire Agreement

This Agreement constitutes the entire agreement between you and WTSolutions regarding the use of the Service and supersedes any prior agreements or understandings, whether written or oral.
